Indictment of Violations Against the Haitian People Since Jovenel Moïse
Count I: Violations of Human RightsThere has been a documented pattern of extrajudicial killings, widespread gang violence, forced displacement, summary executions, and direct attacks on civilians in neighborhoods such as La Saline, Bel Air, Cité Soleil, and others, with over 5,600 killed and 1,500 kidnapped since 2021. Haitian security forces have committed arbitrary arrests and denied due process to protestors and ordinary citizens, compounding the humanitarian crisis.
Count II: Violations of Indigenous Peoples’ RightsAuthorities have systematically refused to recognize the sovereignty, governance structures, and land claims of the Indigenous Haitian Nation; they have suppressed cultural rights, excluded Indigenous voices from political participation, confiscated land, and failed to implement the definitive Indigenous governance regime required by law.
Count III: Violations of International Law (OAS Charter, 1949)State actions have violated OAS Charter commitments: extending executive mandates beyond legal terms, blocking legitimate succession, permitting foreign intervention without proper process, ignoring self-determination, and refusing to protect democratic order and the recognized rights of peoples as mandated by Articles 20 and 21.

Count IV: Eight Specific Acts of Violation
- Unconstitutional extension of presidential mandates.
- State collusion with armed gangs, resulting in terror, sexual violence, and massacres.
- Obstruction of legitimate transitional governance and public accountability.
- Systemic corruption and collapse of government institutions.
- Obstruction of justice in the murder of Jovenel Moïse.
- Suppression of civil rights, including free assembly, free speech, and media freedom, through force and intimidation.
- Erosion of sovereignty by unlawful foreign intervention and loss of control over national territory.
- Militarization of civilian space, targeting unarmed populations, and criminalizing Indigenous self-governance claims.
Count V: Violation of Indigenous Constitutional Rights (Articles 21, 21.1)Failure to formally recognize and establish the permanent regime of Indigenous governance, as constitutionally required.

We remind all ministers, elected or de facto, that we declare conspiracy of treason against the national interest.
Attorneys have no standing in the public trust. The Constitutions are trust indentures created by the people, binding public servants as trustees to act only within the authority granted. No provision of the Federal Constitution nor of the Constitutions of the several states grants attorneys authority to insert themselves between the people and their government. So why are they doing it? Attorneys are not parties to the trust. They are strangers to it. By statute, they may be styled officers of the court, yet they are not constitutional officers. Their licenses are franchises of the legislatures and courts. Mere privileges to practice for pay, not grants of power from the people.
To rely on attorneys for instruction is to allow a hired hand to dictate the terms of the trust. Such misplaced reliance is a breach of fiduciary duty. No trustee may serve two masters. The master of every public servant is the people alone. When a judge, legislator, or executive officer heeds the arguments of attorneys to justify evading constitutional duty, he allows a third party to interfere with the highest contract, the Constitution, and commits unlawful interference with contract.
Maxims of law instruct: An act of the law shall prejudice no man. Jenk 21. He who intermeddles in another's affairs without authority does them at his own peril, Broom, Max 136. Attorneys intermeddle when they presume to redefine the duties of public servants. Public servants who permit it become complicit in the trespass. Let it be entered into the record: the servant does not answer to the servant's servant. The trust is sacred and indivisible.
Any public officer who listens to attorneys instead of to the Constitution betrays the trust and acts in private capacity, stripped of lawful immunity and liable for trespass against the people. Notice: public servants are hereby warned that the council of attorneys is no defense against breach of oath or violation of trust. To heed them in place of the Constitution is to sever yourself from lawful authority and to stand liable in your own person for every injury caused. Attorneys have no standing in the public trust.
This is hereby delivered as notice that violation of the sovereign rights of the Indigenous People, as recognized under law and treaty, constitutes breach of oath, breach of trust, and conspiracy against the Nation.
